Payday loans in Kansas
Under a special short-term part of the Kansas Uniform Consumer Credit Code, licensed supervised lenders in Kansas may provide payday loans up to $500.
- Payday lending
- Allowed
- Max cost
- $15.00 per $100 borrowed
- Top amount
- $500
At that cap, a $100 loan over 14 days can carry $15.00 in fees: $115.00 back in total, close to 391% APR.
Are payday loans legal in Kansas?
Payday loans are indeed legal in Kansas under the payday loan portion of the Kansas Uniform Consumer Credit Code. You may receive a cash advance up to $500 from a licensed lender, who can charge up to 15% and allow seven to 30 days for repayment. On a $100 loan, that fee comes to $15. State rules also cap your borrowing at two open loans with one lender simultaneously, plus a maximum of three loans during any 30 calendar days.
If you cannot pay a loan when due, you may request an extended payment plan one time every 12 months. Your balance gets divided into at least four payments that are nearly equal under this plan. The Kansas Office of the State Bank Commissioner holds no power over lenders wholly owned by a tribe. Some companies claiming tribal status do not actually belong to a tribe. You may submit a consumer assistance form to the state office for investigation if a lender makes that claim.
- The fee equals a flat 15% of the cash advance, a figure the OSBC itself calculates as about 391% APR on a $100 loan lasting 14 days.
- Kansas caps size and frequency alike: one lender may give you at most two open loans at once, and borrowing cannot exceed three loans during any 30-day period.
- Borrowers may cancel a payday loan without cost by returning the cash before the next working day ends.
- Active-duty military borrowers gain protection from a separate statute that includes a ban on garnishing military pay.
- An extended payment plan option available once every 12 months is part of the payday section, last amended in 2024 and effective January 1, 2025.
